Terms of Service for SerenAlign™

1. Acceptance of Terms

By accessing or using SerenAlign™ ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Age Requirement: You must be at least 18 years old to use this Service. If you are under 18, you may only use SerenAlign™ with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

2. Description of Service

SerenAlign™ is a photo and signature formatting service that:

• Formats portrait photos to official Trinidad & Tobago government specifications (Drivers Permit, School IDs)
• Processes handwritten signature images by removing backgrounds and converting them into standardized digital image files
• Provides optional background removal on portraits
• Delivers formatted documents in standardized file formats

3. User Responsibilities

You agree to:

• Provide accurate, current, and complete information
• Upload only images you own or have legal authorization to use
• Use the Service only for lawful purposes
• Not upload images containing illegal content, hate speech, or graphic violence
• Verify that your formatted documents meet all official requirements before submission
• Not attempt to reverse engineer, hack, or compromise the Service

Prohibited Uses:

You may not use SerenAlign™ to:

• Create fraudulent identification documents
• Impersonate another person
• Violate any local, national, or international law
• Upload images of individuals without their consent (except parents uploading children's photos)
• Circumvent security measures or automated systems
• Use the Service in any manner that could damage, disable, or impair our servers

Explicit Consent

By uploading any photo or signature, you provide explicit consent for Savane Digital Solutions to process your biometric data solely for the purpose of document formatting, in accordance with our Privacy Policy.

4. Parental Consent for Minors

If you are uploading images of a child under 18:

• You represent that you are the parent or legal guardian of the child
• You have full legal authority to provide the child's biometric data
• You consent to the processing of the child's image in accordance with our Privacy Policy
• You accept full responsibility for the accuracy and appropriateness of the uploaded images

5. Intellectual Property

Your Content:

• You retain all ownership rights to photos and signatures you upload
• You grant us a temporary, non-exclusive license to process your images solely for the purpose of providing the Service
• This license expires when your data is deleted from our servers (within 1 hour)

Our Content:

• SerenAlign™'s software, design, logos, and branding are owned by Savane Digital Solutions
• You may not copy, modify, distribute, or create derivative works without our written permission
• Our AI background removal technology is used under appropriate licenses and is not trained on your data

6. Payment Terms

Pricing:

• Portrait Photo Only: $20.00 TTD
• Portrait + Signature Bundle: $35.00 TTD
• Prices are subject to change with notice

Payment Processing:

• Payments are processed through WiPay, a third-party payment gateway
• Once formatted documents have been successfully delivered, payments are generally non-refundable, except in cases of verified technical failure.
• We do not store your credit card information

Refund Policy:

• Refunds are generally not provided for completed services where formatted documents have been delivered
• If a technical error prevents delivery, contact us within 24 hours for a refund or re-processing
• Redo coupons are provided for free reformatting within 7 days (one-time use)

7. Service Availability

We strive for 99% uptime but cannot guarantee:

• Uninterrupted or error-free service
• Availability during maintenance periods
• Compatibility with all devices and browsers
• That the Service will meet all your specific requirements

Force Majeure:

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of war, internet service provider failures, power outages, strikes, or failures of third-party services (including payment processors, database providers, and image processing providers).

Maintenance:

• We may perform scheduled or emergency maintenance
• We will attempt to provide advance notice when possible
• No refunds are provided for temporary service unavailability

9. Disclaimer of Warranties

Your Responsibility:

• Verify that formatted documents meet official requirements before submission
• Check image quality and formatting before finalizing your purchase
• Ensure photos meet government appearance standards (neutral expression, proper lighting, etc.)

Due to the automated and AI-assisted nature of background removal and formatting processes, results may vary depending on image quality, lighting, and device conditions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY TRINIDAD & TOBAGO LAW:

• Savane Digital Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you for any claim shall not exceed the amount you paid for the Service
• We are not responsible for rejection of documents by government or other agencies
• We are not liable for delays, data loss, or technical failures beyond our reasonable control

Exceptions:

• This limitation does not apply to liability for fraud, gross negligence, or willful misconduct
• Your statutory rights under Trinidad & Tobago consumer protection laws remain unaffected

11. Indemnification

To protect the integrity of the Service:

You agree to indemnify and hold harmless Savane Digital Solutions, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any law or third-party rights
• Your use of the Service for fraudulent or illegal purposes
• Any content you upload that infringes on intellectual property or privacy rights

12. Third-Party Services

We use the following third-party services to deliver SerenAlign™:

• Vercel: Website hosting and privacy-focused analytics
• WiPay: Payment processing (subject to WiPay's terms and conditions)
• Supabase: Encrypted data storage (subject to Supabase's terms and conditions)
• AI Image Processing Provider: Portrait background removal via a third-party API
• Cloud Processing Provider: Secure sandboxed environment for signature processing on unsupported devices

We are not responsible for the performance, terms, or privacy practices of these third parties. Your use of our Service is subject to their respective terms where applicable.

13. Governing Law & Dispute Resolution

Governing Law:

• These Terms are governed by the laws of the Republic of Trinidad and Tobago
• Any disputes shall be resolved in the courts of Trinidad and Tobago

• Before filing any legal claim, you agree to contact us to attempt to resolve the dispute informally

14. Changes to Terms

• We reserve the right to modify these Terms at any time
• Changes will be effective immediately upon posting with an updated "Effective Date"
• Continued use of the Service after changes constitutes acceptance of the modified Terms
• Material changes will be communicated via notice on our website

15. Termination

We may suspend or terminate your access if:

• You violate these Terms
• You engage in fraudulent activity
• We are required to do so by law
• We cease operations

Effect of Termination:

• Your right to use the Service immediately ends
• Any outstanding payments remain due
• Provisions regarding liability, indemnification, and dispute resolution survive termination

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Savane Digital Solutions regarding the use of SerenAlign™.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
